2. Purpose
The purpose of these general conditions is to regulate the use that may be made by its users of the website of the CATALAN ACADEMY OF CINEMATOGRAPHIC ARTS AND SCIENCES (hereinafter referred to as the Website), which is currently located at the URL http://www.academiadelcinema.cat, without prejudice to the fact that certain services or contents within the Website may be subject to their own conditions.
3. Access to, and use of, the Website
Access to, and use of, the Website is free of charge to users and in a general way does not require prior registration on the part of the user. Nevertheless, access to, and use of, certain information and certain services offered through the Website may only take place after registration by the user.
In cases where users register through user names and passwords, both the user name and the password will belong exclusively to the person to whom they are allocated. Users have the obligation and sole responsibility of keeping both their user name and their password in the strictest and most absolute confidence, therefore assuming responsibility for any damages or consequences of any kind that may result from the breaking or revelation of the secret.
4. Use of the information
The intellectual property rights of all information, data, contents, databases, designs, source codes, browsing structures and other computer services or products integrated into the Website belong exclusively to the ACC, for which reason the User undertakes not to infringe any rights deriving from the ownership of industrial or intellectual property, it being expressly prohibited to reproduce totally or partially the material referred to or to engage in its public communication, distribution or any form of exploitation, without the express written consent of the ACC. Users undertake to use the above information and services exclusively for their own needs and not to engage directly or indirectly in any form of commercial exploitation of the services to which they have access or of the results obtained thanks to the use of the Website, unless they have obtained the express consent of the ACC. Users agree not to use the facilities and services of the Website to engage in or encourage any activities prohibited by law or to attempt to attract users toward other competing services.
5. Operation of the Website
The ACC may undertake any changes to the Website that it considers suitable, and may include additional services and contents or remove those already existing, as appropriate. The ACC may modify the Website whenever it considers it opportune to do so, and may block access to all or some of its users in order to proceed to carry out the modifications or repairs that it may consider necessary at any given time. The ACC shall under no circumstances be responsible for the inadequate operation of the system if this is due to the defective configuration of the user's equipment or to its insufficient ability to support the computer systems that are essential for making use of the service. The ACC undertakes to make every effort to keep up to date the information and contents that it introduces onto the Website, although the user realizes that there may be errors in the contents and services included on the Website, which the ACC will proceed to rectify as quickly as possible upon learning of their presence.
6. Ethical position and responsibility of users making use of the Internet and of the Website
The ACC shall under no circumstances be responsible for the use made of the Website by the User. Users shall, when using the Website or the resources placed at their disposal on it, refrain from engaging in any conduct that infringes on the intellectual or industrial property rights of the ACC or of third parties, that attacks or offends against the honor, personal or family privacy or public image of third parties, or which is illegal or offends against morality, and shall in all cases exonerate the ACC from responsibility in the case of any claim that may be brought against it, before the courts or out of court, as a result of the above use. Users shall refrain from engaging by whatsoever means in any actions to destroy, alter, render unusable or otherwise damage the electronic data, programs or documents belonging to the ACC, or to introduce onto or propagate on the Website network any programs, viruses, applets or any other physical or electronic device which may cause or be capable of causing any type of alteration to the Website network, its system, or to third parties' equipment. 7. Distinctive signs
All distinctive signs, such as brand names, commercial names, etc., which appear on the Website are protected by current legislation relating to brand names, so that Users may not engage in any reproduction, communication, exploitation or use of the above names, unless they can show the prior written agreement given by the owner of the above names.
8. Confidentiality and Protection of Data of a Personal Nature
In compliance with the provisions of Article 5 of Spanish Organic Law No. 15/1999, dated 13th December 1999, concerning the Protection of Data of a Personal Nature (hereinafter referred to as "LOPD"), we inform you of the existence of a personal data file created under the responsibility of the ACC containing Users' personal data with a view to undertaking tasks to inform about and promote the activities and services of the ACC. The file mentioned above is entered in the Spanish General Register for Data Protection with Registration Code No. 2092680874. 9. Legislation applicable and competent jurisdiction
All controversies or claims arising from the interpretation or execution of this Legal Notice shall be governed by Spanish legislation, and shall be submitted to the jurisdiction of the Courts and Magistrate's Courts of Barcelona.
